RESIDENCE APPEALS

Many migrants are coming to New Zealand hoping to get residence sometime in the future. Applying for residence is complicated, and it can take one year or longer before your application is assessed. You may even need to reapply for a new visa so you can stay in New Zealand while waiting to hear from Immigration New Zealand. After all that, you may then find out that your application was unsuccessful. However, Immigration New Zealand does not always get it right. You have a right to appeal your case to the Immigration and Protection Tribunal if you believe that your application was wrongly decided. Keep in mind that you only have limited time to appeal the decision.

DEPORTATION APPEALS

You may be a non-resident, resident or permanent resident and are facing deportation from New Zealand. There are different reasons why you can be deported. For example, your visa has expired, or you have a valid visa but broke the law (which can be as simple as committing a traffic offence). You may have simply breached a visa condition like changing the employer or location contrary to what is stated on your visa.

If you received a deportation liability notice from Immigration New Zealand, then you have a right to appeal to Immigration and Protection Tribunal.  Keep in mind, all appeals must be filed within a short time frame. Your appeal may be allowed if you can demonstrate that you have exceptional circumstances. Exceptional circumstances are not just separation from your family. This means your circumstances must be well outside of what is the norm. If you are facing deportation, we advise that you contact us without delay. We have a wealth of knowledge and experience in all aspects of immigration law.
